The Interactive Wagering Act, Explained
Gov. Jim Justice signed the West Virginia Lottery Interactive Wagering Act — House Bill 2934 — on March 27, 2019. The law ties every online casino license to one of the state’s five existing land-based casinos rather than opening the market to any operator that wants in, and it took roughly sixteen months of regulatory build-out before a single real-money hand actually got dealt. The market went live on July 15, 2020, with DraftKings Casino and BetMGM as the first brands taking bets. Revenue gets taxed at 15% of gross gaming revenue, routed into the state’s Interactive Gaming Fund.
Which Casinos Actually Hold the Licenses
Five properties hold the underlying licenses: Hollywood Casino at Charles Town Races, Mountaineer Casino Racetrack & Resort, Mardi Gras Casino & Resort, Wheeling Island Hotel-Casino-Racetrack, and The Greenbrier. Each can tether up to three online “skins” to its license — the mechanism that lets a national brand like DraftKings or BetMGM operate under a casino’s West Virginia license instead of applying for one on its own. Five casinos times three skins caps the market at fifteen brands; roughly ten actually run today, among them DraftKings Casino, BetMGM, Golden Nugget Casino, Caesars Palace Online Casino, and FanDuel Casino. Cafe Casino’s own game library doesn’t touch any of that structure. Sports Betting Got There First — By Two Years
West Virginia legalized sports betting well before it legalized online casino games, and the gap between the two says something about how the state actually rolls this stuff out.
Hollywood Casino’s Head Start
Hollywood Casino at Charles Town Races took the state’s first legal sports bet on August 30, 2018, about three months after the U.S. Supreme Court struck down the federal ban on state-regulated sports betting. That made West Virginia the fifth state in the country with legal sports betting and the fourth to actually go live post-repeal — ahead of dozens of states that wouldn’t pass a bill for years. Sports wagering settles at a flatter, lower rate than the casino side: 10% of adjusted gross revenue, versus 15% for online casino games. Nine licensed mobile sportsbook apps currently take bets in the state — DraftKings, FanDuel, BetMGM, Caesars Sportsbook, BetRivers, Fanatics Sportsbook, Betly, Golden Nugget, and theScore Bet among them. That rate hasn’t sat still in the legislature: Delegate Adam Burkhammer filed HB 4397 and HB 4398 in January 2026, proposing to push both the sports betting and iGaming rates up to 25%. Neither bill had passed as of mid-2026, so 10% and 15% remain the actual numbers.
Same Appetite, Different Runway
Sports betting and online casino gaming trace back to the same legislative mood, but lawmakers split the online casino piece into its own bill and its own regulatory buildout — hence the sixteen-month gap between HB 2934’s signature and its first online blackjack hand. Retail sports betting never needed that runway; it plugged into betting windows and kiosks the casinos already had running.

How West Virginia Residents Actually Use Cafe Casino
